1. Agreement to Terms

By accessing or using the Samle Platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Samle Platform is a B2B software-as-a-service platform that enables municipalities, property developers, urban planning companies, and other organizations to:

• Create and manage urban planning projects
• Collect and organize citizen feedback
• Export feedback in structured formats (e.g., merknadsskjema)
• Notify citizens about projects affecting their area

3. Account Registration

3.1 Eligibility

You must be a legal entity (company, municipality, organization) to use the Service. You represent and warrant that:

• You have the authority to bind your organization to these Terms
• All information provided during registration is accurate and complete
• You will maintain and update your account information

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. Subscription and Payment

4.1 Subscription Plans

The Service is provided on a subscription basis. Current pricing is available on our website. We reserve the right to modify pricing with 30 days' notice.

4.2 Payment Terms

Subscriptions are billed monthly in advance. Payment is processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees due.

4.3 Renewal and Cancellation

Subscriptions automatically renew unless cancelled. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5. Use of Service

5.1 Permitted Use

You may use the Service solely for lawful business purposes related to urban planning and citizen engagement.

5.2 Prohibited Activities

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or harmful content
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use the Service to collect personal data without proper consent
• Resell or redistribute the Service without authorization

6. Intellectual Property

The Service, including all software, content, and materials, is owned by Samle Platform and protected by intellectual property laws. You retain ownership of data you submit to the Service.

7. Data and Privacy

Your use of the Service is subject to our Privacy Policy. You are responsible for:

• Obtaining necessary consents for data collection
• Complying with applicable data protection laws (e.g., GDPR)
• Ensuring data accuracy and completeness

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues
• Force majeure events

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount paid by you in the 12 months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless Samle Platform from any claims, damages, or expenses arising from:

• Your use of the Service
• Violation of these Terms
• Infringement of third-party rights

11. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay fees when due
• Engage in fraudulent or illegal activity

Upon termination, your access to the Service will cease. We may delete your data after a reasonable retention period.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or Service notification. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by Norwegian law. Any disputes shall be resolved in Norwegian courts.
